Object

These terms of sale are to define the contractual relationship between the seller and the purchaser and the conditions applicable to all purchases made through the online shop www.mobilestar.fr by either professional or individual purchasers.

The acquisition of a product through these websites implies an acceptance by the purchaser of these terms of sale. These conditions shall prevail over any other general or special conditions not specifically approved by the seller.

The seller reserves the right to modify these terms and conditions at any time. In this case, the conditions will be those in force at the date of the order by the purchaser.

Property

Text and photographs of products presented on the website are reserved under copyright and intellectual property, their reproduction, even partial, is strictly prohibited without the agreement of the seller.

Any implementation of hypertext links to the website without the express permission of the legal representative of the company is prohibited.

Characteristics of articles

Description and photographs:
exts and photographs are not included in the contract field. A slight color and texture difference can be observed between the photographs and the actual products. Seller's liability shall be incurred if errors occur.

Availability:
The seller strives to provide the fairest possible information in terms of availability. Delivery times displayed on products currently out of stock are subject to change without notice and depend primarily on information collected from suppliers. Availability posted on the websites are provided for information only and do not represent any contractual commitment.

Prices:

  • Prices in any of the European Union countries: Prices in the catalog are subject to French VAT (free zones and third countries please refer to other countries below). All prices are in Euro.
  • Prices in the other countries: Prices in the catalog include French VAT. Once on the order page, this VAT won't be applied and total price will be without any taxes or customs duties. All prices are in Euro. The purchaser is responsible for the payment of any taxes and customs duties that are due to its country’s administration under the procedure of importation.

The purchaser will only be applied for prices of items mentioned in the catalog at the time of the ordering process. These prices do not include the costs of special packaging, transportation and delivery. These charges are billed by the seller at the end of the ordering process, in addition to the total price of products ordered.

All promotions available on the website, showed in the press, offered by email to those registered to the newsletter or published by various partners, are valid only for the period indicated. Some promotions may be subject to promotional codes. These promotional codes are not cumulative and are not refundable. To enjoy the benefit of promotional codes, the purchaser should include them in the space reserved for this purpose during the ordering process.

Orders

A buyer who wishes to buy a product must:

  • Provide all data requested;
  • Confirm the order after reviewing it;
  • Make payment according to payment options;

The confirmation of the order by the purchaser implies acceptance of these terms of sale, the recognition of having perfect knowledge and waiver of its own conditions of purchase or other conditions. All data recorded and confirmed are valid proof of the transaction. Confirmation will be worth signing and acceptance of transactions.
The seller will send confirmation of the order by email to the purchaser.
For safety reasons and to protect our customers from potential fraud to credit cards and internet payment, all orders are subject to verification. Additional information about the purchaser may be requested to confirm the purchase.

Delivery

A shipping date is specified prior to confirmation of the order. It takes into account the availability and/or replenishment of the products. Depending on the selected carrier, a lead-time is given to the purchaser. If the order is still not sent after 14 days over the initial lead-time given by the seller (if not due to force majeure), the purchaser can cancel the order by informing the seller either by email or mail. The order is considered canceled upon receipt of the letter by the seller if the goods have not been sent yet. The buyer has the right to do so 60 days from delivery date. In this case, the order refund will be made within 30 days.

Any partial delivery, required by the buyer, of an order having products not available temporarily at the agreed delivery date, generates additional costs borne by the buyer.

In case of loss or non-receipt of the package, the purchaser, having its tracking number received by email, should inform the carrier and then inform the seller. The seller conducts a survey with the carrier that may take several days. During this period, no refund or return can be made. After confirming the loss of the package by the carrier, the purchaser will receive the refund of the purchase or the reshipping of the order. However the responsibility for the seller will not be liable if the purchaser indicates an incorrect address when ordering.

In case of damage during the transportation, it is the purchaser to complete a file claim with the carrier and return the item(s). The seller then claims the loss to the carrier and refund the purchaser within 30 days if the claim of the purchaser is registered with the carrier.

In case of non receipt of the parcel shown as "delivered" byt the carrier, the buyer must report the problem to the seller. Deliverers or postal agents are responsible for delivering the parcel in a secure and standardized box. The seller cannot handle reimbursement of an order listed as delivered by the carrier, unless recorded signed delivery option was choosen upon order.

Payment

To complete the order, the purchaser is provided with the forms of payment available on the websites after confirmation of the online purchase. By validating the chosen method of payment, the purchaser guarantees the seller its financial and technical capacities to use the chosen method of payment.

The part dedicated to the online payment is subject to a security system (SSL). The credit card debit is performed on the day of the shipping of the order and not on the validation of the order by the purchaser.

In case of refusal of transaction by the payment center, the seller reserves the right to suspend the corresponding order delivery. The purchaser will then be notified by email and/or telephone and must contact its bank or related payment center to release the transaction.

Loyalty points

Loyalty points are awarded as follows: 5 loyalty points for every euro spent on Mobile Star. They are credited to the buyer website account once the order has been shipped. In case of order return, refund or litigation, the buyer reserves the right to remove loyalty points already allocated. No minimum amount is required to use loyalty points. Each point give a discount of 0.01€. They can be used up to the total amount of the shopping cart.

Receipt and Return policy

For remote purchases, excluding custom products, the purchaser has a period of fourteen days from the date of delivery to exercise his right of withdrawal without having to give reasons or pay penalties. The buyer is responsible for return expenses as per section L 121 of French Consumer Code.

The product must be returned in adequate packaging to protect it so that it remains marketable (cost and risk of return to be borne by the buyer). If this were not the case Mobile Star reserves the right to refuse processing these products.

Refund will be made no taler than 30 days after receiving the item.

Outside period of withdrawal, all fees are not refundable.

Beyound 14 days, a credit will be made in the form of loyalty points on the buyer account. After a month, returns are not accepted.

Warranty

All items are subject to a legal warranty of conformity (L211 1 of French Consumer Code) and a warranty against hidden defects (Article 1641 of French Civil Code), enabling the buyer to return defective items delivered.

Are excluded from the scope of the above warranty, defects or damage caused by wear, outside accident (eg, faulty maintenance, shock, lightning, ...) by usage or installation not in accordance with manufacturer's specifications or recommendations.

For all returns under warranty, the shippment shall be borne by the customer at its own risks. Exchange fees are paid by the seller in France.

Custom products

Design of customized products requires the acceptance of a very slight color difference between the simulation displayed upon order and the final result (after screen calibration, assuming customer screen is correctly set up and calibrated) and +/- 3mm placing accuracy. Depending on the product, printing of the sides may be slightly stretched. These points cannot be a cause of return or exchange. Similarly, and as indicated, the safety zone is required. Any non-printed part on the final product resulting from the non-filling of this area by the buyer can not be a cause of return or exchange. Customized products cannot be returned or exchanged as non-marketable, outside justified quality problem.

Responsibility

The seller, in the process of selling online is only bound by an obligation of means, his liability can not be held liable for damages resulting from the use of the Internet such as data loss, intrusion, viruses, break service, or other unintended problems.
